OBJECTIONS AND SUPPORT ARE IMPORTANT FOR BUILDING LINE RELAXATION APPLICATIONS

The City of Ekurhuleni may approve the building line relaxation for any property in any use zone if it is seen as an improvement in the development of the property.

This relaxation must not interfere with amenity, character and aesthetics of the neighbourhood.

The relaxation of the building line on the building plan may be considered provided provision is made for the affected neighbour’s endorsement of the relaxation on the building plan, and application form.

The City’s Town Planning Scheme 2014 states that affected neighbours have 28 days to object or support the relaxation of the building line. If the 28 days lapse without any objection, the relaxation will continue.

In consideration of the building line relaxation the City will consider, inter alia, the size of the property and positioning and height of buildings, amenity of the neighbourhood, road reserve widths and sight distances as well as possible adverse on the neighbouring properties. The existing buildings and consents for relaxations already granted in the immediate vicinity of the application

If there are objections that cannot be resolved, the matter is referred to the relevant Tribunal/Appeal committee, for consideration.
